Terms of Service for Maple Ridge Garden Services Ltd.

These Terms of Service (the “Terms”) govern the provision of gardening and related outdoor maintenance services by Maple Ridge Garden Services Ltd. (“Maple Ridge Garden Services Ltd.”, “we”, “us”, or “our”) to clients (“you” or “your”). By requesting, scheduling, accepting, or paying for any services from Maple Ridge Garden Services Ltd., you agree to be bound by these Terms.

1. Introduction and acceptance of terms

These Terms form a binding agreement between you and Maple Ridge Garden Services Ltd. for the use of our services. If you do not agree with these Terms, you must not engage our services.

We may provide services in person, by telephone, by email, through quotations, invoices, written work orders, or other communication methods. Any estimate, quote, schedule, or service confirmation is subject to these Terms unless otherwise agreed in writing by Maple Ridge Garden Services Ltd.

2. Scope of services

Maple Ridge Garden Services Ltd. provides garden-related services, which may include, without limitation:

  • Garden maintenance;
  • Seasonal spring and fall cleanups;
  • Planting and garden bed design;
  • Mulching and soil improvement;
  • Hedge trimming and pruning;
  • Lawn edging and weed control; and
  • Container and patio garden care.

Service details, timing, frequency, materials, and pricing may vary depending on property conditions, seasonality, accessibility, weather, plant health, and the scope agreed in the quote, estimate, invoice, or work order.

Unless expressly stated otherwise, our services are limited to horticultural and maintenance activities. We do not provide structural, electrical, plumbing, pest extermination, arborist, or hazardous material remediation services.

3. User obligations and responsibilities

You agree to:

  • Provide accurate, complete, and current information about the property and requested services;
  • Ensure safe and reasonable access to the property, including gates, pathways, water access, and any required entry instructions;
  • Disclose all known hazards, including underground utilities, unstable surfaces, aggressive animals, contaminated soil, hidden obstructions, or restricted areas;
  • Obtain any required permissions, approvals, permits, strata authorizations, landlord consent, or municipal permissions necessary for the services;
  • Secure pets, children, valuables, fragile items, and personal property before service begins;
  • Inform us of irrigation systems, sprinkler heads, lighting, cables, buried lines, or sensitive plants that may require special care; and
  • Review completed work promptly and raise concerns within a reasonable time after service completion.

You acknowledge that failure to meet these responsibilities may affect service quality, cause delays, increase charges, or result in suspension or cancellation of services.

4. Payment terms and conditions

Unless otherwise agreed in writing, payment is due upon completion of services or upon receipt of an invoice. Maple Ridge Garden Services Ltd. may require a deposit, prepayment, or partial payment for recurring, seasonal, large-scale, or custom projects, including planting and garden bed design, mulching, and major cleanup work.

All prices, quotes, and estimates are subject to change if the scope of work changes, if additional labor or materials are required, or if site conditions differ materially from what was represented at the time of quoting.

Unless stated otherwise, quoted prices do not include applicable taxes, disposal fees, special materials, plant stock, delivery charges, permit fees, or third-party costs. You are responsible for all applicable taxes and approved additional charges.

Late or overdue balances may be subject to interest or administrative fees to the extent permitted by applicable law and disclosed on the invoice or service agreement. We may suspend further services until outstanding amounts are paid in full.

If a payment is returned, reversed, or charged back without valid reason, you agree to reimburse any related bank, processing, collection, and administrative costs incurred by Maple Ridge Garden Services Ltd., to the extent permitted by law.

5. Cancellation and refund policy

You may cancel or reschedule a service by providing reasonable notice. Cancellation terms may vary depending on the type of service, materials ordered, scheduling commitments, and weather-sensitive work.

For recurring maintenance services, we may require advance notice before the next scheduled visit to avoid cancellation charges. For custom work, design work, seasonal cleanups, or projects involving purchased materials or reserved labor time, cancellations made after work has been scheduled or materials have been ordered may incur charges for labor, restocking, delivery, or non-recoverable expenses.

Refunds, if any, are assessed on a case-by-case basis. Completed services are generally non-refundable except where required by applicable law or where Maple Ridge Garden Services Ltd. determines, in its reasonable discretion, that a partial refund or re-performance is appropriate.

Weather conditions, seasonal plant behavior, drought, disease, pests, and other natural factors may affect results and are not grounds for a refund if the services were properly performed.

6. Liability limitations

To the maximum extent permitted by applicable Canadian law, Maple Ridge Garden Services Ltd. shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of enjoyment, loss of use, loss of profit, loss of plants, or loss of business opportunity, arising from or relating to the services.

Without limiting the foregoing, Maple Ridge Garden Services Ltd. is not responsible for:

  • Pre-existing property damage, soil conditions, drainage issues, disease, pests, or plant decline;
  • Damage caused by hidden defects, buried utilities, or undisclosed hazards;
  • Damage caused by weather, storms, frost, heat, drought, flooding, or other natural events;
  • Failure of irrigation systems, electrical systems, lighting, or other third-party infrastructure;
  • Results affected by the age, species, condition, or suitability of plants selected by you;
  • Any items left in the work area that are not removed or secured by you.

Where liability cannot be excluded under law, Maple Ridge Garden Services Ltd.’s total aggregate liability for any claim arising from the services shall be limited to the amount paid by you for the specific service giving rise to the claim, subject to applicable law.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded under applicable law, including liability for fraud, wilful misconduct, or other liability that cannot be limited under Canadian law.

7. Intellectual property rights

All intellectual property rights in our business materials, service descriptions, estimates, templates, designs, plans, photographs, content, branding, and related documentation remain the property of Maple Ridge Garden Services Ltd. or its licensors unless otherwise agreed in writing.

Any garden plans, design concepts, sketches, recommendations, or written materials provided to you may be used by you solely for the property and purpose for which they were created. You may not reproduce, distribute, publish, or commercially exploit our materials without prior written consent, except as permitted by law.

We may use photographs or descriptions of completed work for marketing or portfolio purposes, provided that we do so in compliance with applicable privacy laws and any confidentiality obligations agreed in writing.

8. Data protection and privacy

Maple Ridge Garden Services Ltd. collects, uses, stores, and discloses personal information only as necessary to provide services, manage customer relationships, process payments, communicate with you, fulfill legal obligations, and operate our business.

We may collect information such as your name, address, contact details, service preferences, property access instructions, billing details, and service history. We take reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, loss, misuse, or disclosure.

We may share personal information with service providers, payment processors, contractors, insurers, legal advisors, and other third parties only as reasonably necessary for business operations or as required by law.

Our handling of personal information is subject to applicable Canadian privacy laws, including British Columbia and federal privacy requirements where applicable. By using our services, you consent to the collection, use, and disclosure of personal information as described in these Terms and in any applicable privacy practices we may provide.

9. Force majeure

Maple Ridge Garden Services Ltd. shall not be liable for any delay, failure, or inability to perform due to events beyond our reasonable control, including but not limited to severe weather, wildfire, flooding, extreme temperatures, labour disputes, government action, utility outages, transportation disruption, supply shortages, equipment failure, public health emergencies, or acts of God.

In such circumstances, we may reschedule services, modify the scope of work, suspend services, or cancel affected appointments without liability, except for amounts already earned for work performed or materials already purchased.

10. Changes to terms

Maple Ridge Garden Services Ltd. may update or modify these Terms from time to time. Any changes will take effect when posted, communicated, or otherwise made available to you, unless a later effective date is stated.

Your continued use of our services after changes become effective constitutes acceptance of the revised Terms. If you do not agree with any update, you should discontinue use of our services and notify us promptly.

11. Applicable law and jurisdiction

These Terms and any dispute arising out of or relating to them, the services, or any related matter shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

You agree that the courts located in British Columbia, Canada shall have exclusive jurisdiction over any dispute, claim, or proceeding arising from or related to these Terms or the services, subject to any mandatory consumer protection or other non-waivable rights under applicable law.

13. Severability clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

If any invalid or unenforceable provision can be amended to make it valid and enforceable, the provision shall be interpreted to reflect the original intent as closely as permitted by law.
